Términos y Condiciones: Promoción "10 Grupos, 1 Pasaje"

Resumen
El primer participante inscrito que traiga a Wearsos Turrialba 10 grupos que califiquen, entre el 1 de octubre y el 15 de diciembre de 2026, gana un (1) pasaje de ida y vuelta en Southwest Airlines. Existe un solo pasaje. Cada grupo debe consumir un mínimo de US$100 (IVA incluido) e informar al personal, durante la visita, que participa en la promoción. Cuando se registra el décimo grupo del ganador, la promoción termina de inmediato para todos. Esto no es una rifa ni un sorteo: no interviene el azar.
1. Organizador
La promoción "10 Grupos, 1 Pasaje" (la "Promoción") es organizada y administrada exclusivamente por Wearsos S.R.L., cédula jurídica 3-102-854873, con domicilio contiguo a la Av. 6, Turrialba, Cartago, 30501, Costa Rica ("Wearsos"). Contacto: 10-1@wearsos.co, +506 8806 7481.
2. Naturaleza de la Promoción
La Promoción premia el desempeño. No es una rifa, sorteo, lotería ni juego de azar, y no se realiza ningún sorteo. El premio se otorga al primer Participante que cumpla todos los requisitos.
3. Vigencia
La Promoción rige desde el 1 de octubre de 2026 a las 00:00 hasta el 15 de diciembre de 2026 a las 23:59, hora de Costa Rica (UTC-6), o hasta que un Participante complete 10 Grupos Calificados, lo que ocurra primero.
4. Quiénes pueden participar
4.1 Agencias de viaje, tour operadores, DMC, instituciones educativas y demás personas jurídicas, así como personas físicas mayores de 18 años con plena capacidad legal ("Participantes").
4.2 No pueden participar los colaboradores, contratistas, artesanas, pasantes y voluntarios de Wearsos, sus familiares cercanos ni quienes vivan con ellos.
4.3 Quien participe como empleado o representante de una empresa o institución es responsable de confirmar que las políticas de su empleador le permiten recibir el premio. Wearsos puede entregar el premio a la empresa en lugar de a la persona.
4.4 Cada Participante declara que referir grupos a Wearsos no incumple ninguna obligación con sus clientes o su empleador.
4.5 La Promoción no es válida donde la ley la prohíba o restrinja.
5. Inscripción
5.1 Los Participantes se inscriben en persona en la tienda de Wearsos en Turrialba o escribiendo a 10-1@wearsos.co, indicando su nombre completo o razón social, número de cédula o identificación, correo electrónico y teléfono. La inscripción en tienda puede hacerse el mismo día de la visita del primer grupo.
5.2 Wearsos confirmará la inscripción por correo electrónico, con el enlace a estos Términos. Cuentan los grupos a partir de la inscripción, incluido el grupo presente en la tienda al momento de inscribirse. Las visitas anteriores no cuentan.
5.3 Al inscribirse, ya sea firmando el registro en tienda o enviando el correo de inscripción, el Participante acepta estos Términos y Condiciones, incluido el uso de sus datos descrito en la cláusula 16.
6. Grupos Calificados
6.1 Una visita cuenta como "Grupo Calificado" solo si cumple todo lo siguiente:
(a) Al menos 2 personas visitan juntas, en la misma fecha, la tienda y taller de Wearsos en Turrialba.
(b) Las compras del grupo pagadas a Wearsos en esa visita suman al menos US$100, IVA incluido, o su equivalente en colones al tipo de cambio que Wearsos aplique ese día. Cuentan productos, consumo en el café, y tarifas del Upcycling Tour y talleres de ese grupo por el monto efectivamente pagado a Wearsos. En tours reservados por una agencia, cuenta la tarifa neta facturada a la agencia.
(c) El Participante o el líder del grupo informa al personal de Wearsos, durante la visita y antes de que el grupo se retire, que el grupo participa en la Promoción, e indica el nombre del Participante. Los grupos que no se identifiquen durante la visita no cuentan. No se reconocen grupos de forma retroactiva en días posteriores.
(d) Las compras quedan registradas en facturas o en el sistema de punto de venta de Wearsos con la fecha de la visita.
6.2 No cuentan las compras en línea, la compra de tarjetas de regalo, ni las compras devueltas, anuladas o reversadas. Si una compra se reversa después de acreditado el grupo y este queda por debajo del mínimo, el grupo deja de contar.
6.3 Cada grupo cuenta una sola vez y para un solo Participante. Si dos Participantes reclaman el mismo grupo, cuenta para el que se indicó primero al personal.
6.4 No se permite dividir un grupo en grupos más pequeños, ni contar a las mismas personas como más de un grupo en la misma fecha.
7. Conteo
Wearsos lleva el conteo oficial de Grupos Calificados. Cada Participante puede solicitar su conteo en cualquier momento a 10-1@wearsos.co. Wearsos corregirá cualquier error que se le demuestre con facturas o comprobantes.
8. Premio único y cierre
8.1 Existe un solo premio: un (1) pasaje de ida y vuelta en Southwest Airlines (el "Premio").
8.2 Gana el primer Participante cuyo décimo Grupo Calificado quede registrado. El momento que decide es la hora de la factura o registro de pago del décimo grupo en el sistema de Wearsos. Si dos registros tienen la misma hora, gana el Participante que se inscribió primero.
8.3 Cierre inmediato. Al registrarse ese décimo grupo, la Promoción termina automáticamente para todos los Participantes. Los grupos y compras posteriores no cuentan, aunque el Participante desconozca el cierre.
8.4 Anuncio del cierre. Wearsos publicará el cierre en esta página y en Instagram @wearsos.co dentro de las 48 horas siguientes. Es responsabilidad exclusiva de cada Participante mantenerse informado. Wearsos no está obligado a notificar a cada Participante de forma individual. Los grupos llevados después del cierre no generan derecho a premio, compensación ni reconocimiento alguno.
8.5 Los grupos acumulados por quienes no ganen no tienen valor, no son canjeables y no se trasladan a otras promociones.
8.6 Si nadie completa 10 Grupos Calificados al 15 de diciembre de 2026, el Premio se declara desierto y no se entrega ningún sustituto.
8.7 Wearsos verificará al ganador dentro de 2 días hábiles. Si el ganador es descalificado o el Premio se anula antes de su emisión, Wearsos podrá otorgarlo al Participante con más Grupos Calificados al momento del cierre (en caso de empate, al que alcanzó esa cantidad primero) o declararlo desierto.
9. Detalles del Premio
9.1 Un pasaje de ida y vuelta en clase económica, en las rutas y condiciones que Southwest Airlines permita para el tipo de pasaje del que dispone Wearsos.
9.2 El Premio debe emitirse antes del 31 de diciembre de 2026. Para lograrlo, el ganador debe entregar a Wearsos los datos del viajero (nombre completo tal como aparece en el pasaporte, fecha de nacimiento y cualquier otro dato que la aerolínea requiera para la emisión) dentro de los 5 días naturales siguientes a la notificación, y a más tardar el 23 de diciembre de 2026. Si no los entrega a tiempo, pierde el Premio sin derecho a compensación.
9.3 El pasaje podrá utilizarse dentro del plazo de vigencia que establezca Southwest Airlines, el cual Wearsos comunicará al ganador al momento de la emisión. Su uso está sujeto a la disponibilidad, fechas restringidas y condiciones de la aerolínea, que Wearsos no controla ni garantiza.
9.4 El Premio cubre la tarifa del pasaje. Cualquier impuesto, tasa o cargo que Southwest Airlines o las autoridades cobren al viajero corre por cuenta del viajero. El Premio tampoco incluye equipaje adicional, selección de asiento, transporte terrestre, hospedaje, alimentación, seguros, pasaporte, visas ni ningún otro gasto.
9.5 El viajero debe contar con pasaporte vigente y con la visa y demás documentos migratorios requeridos. Wearsos no es responsable si se le niega el abordaje o el ingreso a un país.
9.6 Una vez emitido, el pasaje se rige por el contrato de transporte y las políticas de Southwest Airlines. Retrasos, cancelaciones y cambios se tramitan con la aerolínea, y Wearsos no responde por ellos.
9.7 El Premio no tiene valor en efectivo, no es canjeable por dinero y no puede venderse ni transferirse una vez emitido. Wearsos no está obligado a reponerlo si se pierde, vence o no se utiliza.
9.8 Wearsos notificará al ganador por el correo y teléfono de su inscripción.
10. Relación con otros acuerdos
Participar no crea una relación laboral, de agencia, sociedad ni franquicia con Wearsos. El Premio es adicional a cualquier comisión que Wearsos pague al Participante según los acuerdos comerciales vigentes entre ambos. Los Participantes no pueden presentarse como representantes de Wearsos.
11. Southwest Airlines
Southwest Airlines® es una marca registrada de Southwest Airlines Co. y se menciona únicamente para describir el Premio. Esta Promoción es creada, organizada y administrada exclusivamente por Wearsos. Southwest Airlines Co. no patrocina, organiza ni administra la Promoción y no tiene responsabilidad alguna en relación con ella. Toda consulta debe dirigirse a Wearsos.
12. Impuestos
El ganador es responsable de cualquier impuesto derivado del Premio. Wearsos podrá solicitar información tributaria y emitirá o retendrá lo que la ley exija.
13. Conducta y descalificación
Wearsos puede descalificar a cualquier Participante, y anular grupos acreditados o el Premio, por fraude, información falsa, manipulación de la Promoción o trato irrespetuoso hacia el personal, las artesanas o los visitantes. Cada Participante es responsable de que sus grupos respeten las normas de la tienda y el taller.
14. Responsabilidad
En la medida permitida por la ley, Wearsos no responde por pérdidas, lesiones o daños derivados de la participación en la Promoción o del uso del Premio, incluido el viaje. Tampoco responde por errores técnicos o de registro, que corregirá al detectarlos, ni por hechos fuera de su control razonable. Nada en estos Términos limita los derechos irrenunciables de la Ley 7472 ni de otra normativa aplicable.
15. Cambios y suspensión
Wearsos puede modificar o suspender la Promoción por fraude, fuerza mayor o requerimiento legal, y publicará los cambios en esta página con la fecha actualizada. Ningún cambio reducirá los Grupos Calificados ya acreditados.
16. Datos personales
Wearsos trata los datos recopilados conforme a la Ley 8968 para administrar la Promoción, emitir el Premio y con fines de mercadeo. Al inscribirse, el Participante consiente que Wearsos use sus datos de contacto para enviarle información sobre sus productos, tours, experiencias y promociones por correo electrónico, WhatsApp u otros medios. El Participante puede revocar este consentimiento en cualquier momento, sin que ello afecte su participación. Wearsos no vende ni cede estos datos a terceros. Los datos del viajero se compartirán con la aerolínea en lo necesario para la emisión. Al inscribirse, el Participante autoriza a Wearsos a publicar su nombre o razón social si resulta ganador. Cualquier uso de imagen o testimonio requiere autorización escrita adicional. Puede solicitar acceso, rectificación o eliminación de sus datos en 10-1@wearsos.co.
17. Ley aplicable e idioma
Estos Términos se rigen por las leyes de la República de Costa Rica. Cualquier controversia será resuelta por los tribunales competentes de Turrialba, Cartago, sin perjuicio de los derechos irrenunciables indicados en la cláusula 14. Estos Términos se publican en español e inglés. En caso de discrepancia, prevalece la versión en español.

Summary
The first registered participant to bring 10 qualifying groups to Wearsos Turrialba between October 1 and December 15, 2026 earns one (1) round-trip ticket on Southwest Airlines. There is only one ticket. Each group must spend at least US$100 (IVA included) and must tell our staff, during the visit, that it is part of the promotion. When the winner's 10th group is recorded, the promotion ends immediately for everyone. This is not a raffle or a sweepstakes: no chance is involved.
1. Organizer
The "10 Groups, 1 Ticket" promotion (the "Promotion") is organized and administered solely by Wearsos S.R.L., cédula jurídica 3-102-854873, located Contiguo a la Av. 6, Turrialba, Cartago, 30501, Costa Rica ("Wearsos"). Contact: 10-1@wearsos.co, +506 8806 7481.
2. Nature of the Promotion
The Promotion rewards performance. It is not a raffle, sweepstakes, lottery or game of chance, and no drawing takes place. The prize goes to the first Participant who meets all requirements.
3. Promotion Period
The Promotion runs from October 1, 2026 at 00:00 until December 15, 2026 at 23:59, Costa Rica time (UTC-6), or until a Participant completes 10 Qualifying Groups, whichever comes first.
4. Eligibility
4.1 Open to travel agencies, tour operators, DMCs, educational institutions and other legal entities, and to individuals 18 or older with full legal capacity ("Participants").
4.2 Not eligible: employees, contractors, artisans, interns and volunteers of Wearsos, and their immediate families and household members.
4.3 If you participate as an employee or representative of a company or institution, you are responsible for confirming that your employer's policies allow you to receive the prize. Wearsos may issue the prize to the employer instead of the individual.
4.4 Each Participant confirms that referring groups to Wearsos does not breach any obligation to its clients or employer.
4.5 Void where prohibited or restricted by law.
5. Registration
5.1 Participants register in person at the Wearsos store in Turrialba or by emailing 10-1@wearsos.co, providing full legal or company name, ID or cédula number, email and phone. In-store registration may take place on the same day as the first group's visit.
5.2 Wearsos will confirm registration by email, including a link to these Terms. Groups count from the moment of registration, including the group present in the store when the Participant registers. Earlier visits do not count.
5.3 By registering, whether by signing the in-store register or by sending the registration email, the Participant accepts these Terms and Conditions, including the use of data described in Section 16.
6. Qualifying Groups
6.1 A visit counts as a "Qualifying Group" only if all of the following are met:
(a) At least 2 people visit the Wearsos store and workshop in Turrialba together on the same date.
(b) The group's purchases paid to Wearsos during that visit total at least US$100, IVA included, or the colón equivalent at the exchange rate Wearsos applies that day. Products, café purchases, and Upcycling Tour and workshop fees for that group count at the amount actually paid to Wearsos. For tours booked by an agency, the net rate invoiced to the agency counts.
(c) The Participant or group leader tells Wearsos staff during the visit, before the group leaves, that the group is part of the Promotion and gives the Participant's name. Groups not identified during the visit do not count. No retroactive credit is given on later days.
(d) The purchases are recorded on Wearsos invoices or point-of-sale records dated the day of the visit.
6.2 Online orders, gift card purchases, and purchases that are returned, cancelled or reversed do not count. If a purchase is reversed after a group is credited and the group falls below the minimum, the group no longer counts.
6.3 Each group counts once and for one Participant only. If two Participants claim the same group, it counts for the one named first to staff.
6.4 Splitting one group into smaller groups, or counting the same people as more than one group on the same date, is not allowed.
7. Tracking
Wearsos keeps the official count of Qualifying Groups. Participants may request their count at any time at 10-1@wearsos.co. Wearsos will correct any error shown with invoices or receipts.
8. Single prize and closing
8.1 There is one prize only: one (1) round-trip ticket on Southwest Airlines (the "Prize").
8.2 The winner is the first Participant whose 10th Qualifying Group is recorded. The deciding moment is the time of the invoice or payment record for the 10th group in Wearsos' system. If two records show the same time, the Participant who registered first wins.
8.3 Immediate close. When that 10th group is recorded, the Promotion ends automatically for all Participants. Later groups and purchases do not count, even if the Participant was unaware of the close.
8.4 Closing announcement. Wearsos will post the close on this page and on Instagram @wearsos.co within 48 hours. Each Participant is solely responsible for staying informed. Wearsos has no obligation to notify Participants individually. Groups brought after the close create no right to a prize, compensation or recognition of any kind.
8.5 Groups accumulated by non-winning Participants have no value, cannot be exchanged, and do not carry over to other promotions.
8.6 If no one completes 10 Qualifying Groups by December 15, 2026, the Prize is declared void and no substitute is awarded.
8.7 Wearsos will verify the winner within 2 business days. If the winner is disqualified or the Prize is voided before issuance, Wearsos may award it to the Participant with the most Qualifying Groups at closing (if tied, the one who reached that number first) or declare it void.
9. Prize details
9.1 One round-trip economy ticket, on the routes and conditions Southwest Airlines allows for the type of ticket available to Wearsos.
9.2 The Prize must be issued before December 31, 2026. To make this possible, the winner must give Wearsos the traveler's details (full name exactly as on the passport, date of birth, and any other information the airline requires for issuance) within 5 calendar days of notification, and no later than December 23, 2026. If the details are not provided in time, the Prize is forfeited without compensation.
9.3 The ticket may be used within the validity period set by Southwest Airlines, which Wearsos will communicate to the winner at issuance. Use is subject to the airline's availability, blackout dates and conditions, which Wearsos does not control or guarantee.
9.4 The Prize covers the ticket fare. Any taxes, fees or charges that Southwest Airlines or any authority charges the traveler are the traveler's responsibility. The Prize also excludes extra baggage, seat selection, ground transportation, lodging, meals, insurance, passports, visas and any other expense.
9.5 The traveler must hold a valid passport and any required visa and entry documents. Wearsos is not responsible if the traveler is denied boarding or entry to any country.
9.6 Once issued, the ticket is governed by Southwest Airlines' contract of carriage and policies. Delays, cancellations and changes are handled with the airline, and Wearsos is not liable for them.
9.7 The Prize has no cash value, cannot be exchanged for money, and cannot be sold or transferred once issued. Wearsos is not obligated to replace it if lost, expired or unused.
9.8 Wearsos will notify the winner using the email and phone provided at registration.
10. Relationship to other agreements
Participation does not create an employment, agency, partnership or franchise relationship with Wearsos. The Prize is in addition to any commission Wearsos pays the Participant under the commercial agreements in force between them. Participants may not present themselves as Wearsos representatives.
11. Southwest Airlines
Southwest Airlines® is a registered trademark of Southwest Airlines Co. and is mentioned only to describe the Prize. This Promotion is created, organized and administered exclusively by Wearsos. Southwest Airlines Co. does not sponsor, organize or administer the Promotion and has no responsibility in connection with it. All questions should be directed to Wearsos.
12. Taxes
The winner is responsible for any taxes arising from the Prize. Wearsos may request tax information and will issue or withhold whatever the law requires.
13. Conduct and disqualification
Wearsos may disqualify any Participant, and cancel credited groups or the Prize, for fraud, false information, manipulation of the Promotion, or disrespectful conduct toward staff, artisans or visitors. Each Participant is responsible for its groups following store and workshop rules.
14. Liability
To the extent permitted by law, Wearsos is not liable for loss, injury or damage arising from participation in the Promotion or use of the Prize, including travel. Wearsos is also not liable for technical or recording errors, which it will correct once identified, or for events beyond its reasonable control. Nothing in these Terms limits non-waivable rights under Costa Rica's Ley 7472 or other applicable law.
15. Changes and suspension
Wearsos may modify or suspend the Promotion for fraud, force majeure or legal requirement, and will post changes on this page with the updated date. No change will reduce Qualifying Groups already credited.
16. Personal data
Wearsos processes the data collected under Costa Rica's Ley 8968 to run the Promotion, issue the Prize, and for marketing purposes. By registering, the Participant consents to Wearsos using its contact details to send information about Wearsos products, tours, experiences and promotions by email, WhatsApp or other channels. The Participant may withdraw this consent at any time without affecting its participation. Wearsos does not sell or transfer this data to third parties. The traveler's data will be shared with the airline as needed for issuance. By registering, the Participant authorizes Wearsos to publish its name or company name if it wins. Any use of image or testimonial requires separate written consent. You may request access, correction or deletion of your data at 10-1@wearsos.co.
17. Governing law and language
These Terms are governed by the laws of the Republic of Costa Rica. Any dispute will be resolved by the competent courts of Turrialba, Cartago, without affecting the non-waivable rights noted in Section 14. These Terms are published in Spanish and English. In case of any discrepancy, the Spanish version prevails.
